The Department of Justice has used the Alien Terrorist Removal Court for the first time since its establishment three decades ago to deport a 47-year-old Afghan woman. The woman, who was lawfully residing in Texas, agreed to her removal after being accused of plotting an ISIS-inspired mass shooting on Election Day 2024. Former DHS official Jonathan Fahey stated that this mechanism is an effective tool for removing dangerous individuals, particularly those from Afghanistan, where vetting was limited during the withdrawal.

WHY IT MATTERS

This case sets a precedent for using the Alien Terrorist Removal Court as a tool to deport individuals deemed a threat, especially those who may have entered the U.S. with limited vetting, potentially enhancing national security.

ALSO DISCUSSED

The episode also touches on changes to airport security following 9/11, including the ability for TSA PreCheck members to accompany ticketed passengers to the gate.
